Contest Dates:
This contest will take place on the following event dates: 3/21/24 through 4/8/24. This promotion is subject to all federal, state, and local laws, and is void where prohibited by law.

Who May Enter & Who is Eligible:
This promotional contest is open to legal residents of the United States age (18) and older with a valid federal or state identification and reside in Ada County, Idaho, Canyon County, Idaho, or who live in the Boise, Idaho Designated Market Area (DMA) as defined by Nielsen Media Research, Inc.except the following classes of persons who are ineligible to participate:
Employees or family members of employees of Iliad Media Group, GPP, or any other promotional agency otherwise associated with this event are not eligible to participate or win this contest.
Persons who have won another contest or promotion of any kind from Iliad Media Group within 30 calendar days before the contest are not eligible to participate or win this contest.

How to Enter:
There is no purchase necessary to enter or participate in the contest. Contest can be entered by scanning the QR code and follow the directions provided to log in or create a free account for the Promotion (“Account”) beginning 3/17/2024 ending prior to tip off of the first game on 3/21/2021.

By participating and submitting a game play, participant agrees that Sponsor and any other participating parties are authorized to contact participant via email or any other form of media to make participant aware of information pertinent to the promotion, and to distribute information regarding the Sponsor featured products, special events or promotional offers, or purchase incentives, provided participant has opted-in to receive such information. Participants may opt-out of any further email communication at any time by simply following the provided opt-out instructions in email. Participation will be subject to Sponsor’s privacy policy available at https://www.actiongm.com/PrivacyPolicy.

The game will be conducted among and between all eligible Entries received during the corresponding Entry Period. Entries must be received before the end of an Entry Period to be eligible for the corresponding Entry Period prizing. All Entries become the property of Sponsors and will not be acknowledged or returned. Entry Period start times and end times are subject to change at the discretion of the Sponsor.

You may submit only one (1) Entry for each Entry Period. Multiple Entries received from email address beyond this limit will void all such additional Entries. Sponsors’ computer shall be the official timekeeper for all matters related to the Promotion. Entries that are incomplete, garbled, corrupted, suspect, fraudulent, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. “Receipt” of an Entry only occurs when Sponsors’ servers record an entrant’s registration information and Entry during the corresponding Entry Period. Screen shots, printouts or any other purported “proof” or “evidence” of entry or winning whatsoever, in lieu of Sponsors’ validation process, shall not be binding under any circumstances. Proof of submission (such as an automated receipt, screen shots, electronic mail, etc.) shall not constitute proof of actual receipt of Entry for purposes of these Official Rules. In case of a dispute over the identity of an entrant, the authorized account holder email address used to enter will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

HOW TO PLAY: Eligible entrants will be asked to make predictions of all (64) winners of the 2024 Men’s NCAA Basketball Tournament. All eligible entries must be received prior to tip off of the first game on 3/21/24. Each entry must include the contestant’s name, e-mail address, and their prediction of all (64) winners of the 2024 Men’s NCAA Basketball Tournament. Only the entries actually received by the client, then subsequently submitted to and received by the independent auditor will be eligible for this contest. Any entry not received by the independent auditor will be disqualified, regardless of the accuracy of the prediction.

Following the conclusion of games, entrants will receive one point for each correct prediction. Whether a prediction is correct will be based on the outcome of gameplay, and/or results of the 2024 Men’s NCAA Basketball Tournament.
All Entries may only be submitted through the entry process available through their Account. Any effort by a participant or any third party to misrepresent themselves or misrepresent their eligibility, qualifications, or any other information, as determined by Sponsor in its sole discretion, will disqualify that participant. Sponsor’s determination of eligibility, in its sole discretion, shall be final. In the event any party challenges a term or provision of these Promotion Official Rules, the party hereby expressly waives any and all opportunities to recover any amount, or collect any prize, from Sponsor relating to this Promotion or otherwise.
Grand Prize: In order for the grand prize to be awarded, an eligible contestant that submitted a valid entry must have predicted the actual 60 or more winners in the 2024 Men’s NCAA tournament. The grand prizes for this contest is a N0908 Sand Storm 2450SRX.

First Prize: In order for the first prize to be awarded, an eligible contestant that submitted a valid entry must have predicted a minimum of 57-59 winners in the 2024 Men’s NCAA tournament. The grand prizes for this contest $5,000.00 Cash.

Consolation Prize: The contestant with the most correct picks in the 2024 Men’s NCAA tournament. The consolation prize is a “65” SamsungUHD 4k Smart Television

A maximum of one (1) Grand Prize, First Prize, and Consolation Prize, will be available to be awarded. If none of the (2,000) official finalist prediction(s) matches the actual results of the tournament, no grand or first prize will be awarded. In the event of a tie for Grand Prize, First Prize, or Consolation Prize, a random drawing between all tied entrants will determine the winner, subject to verification of eligibility. Unclaimed prizes will not be awarded. All federal, state, and local taxes and any other costs and expenses associated with prize acceptance and use are the responsibility of the winners. Prizes are non-transferable and no prize substitution will be allowed, except by Sponsor, which reserves the right to substitute a prize with one of comparable or greater value. Potential Grand and First prize winners (if applicable) will be required to complete and return a W-9 form or appropriate tax form, affidavit of eligibility, and liability/publicity release (unless prohibited by law), and present a valid driver’s license before prize is awarded. Grand and First Prize winners (if applicable) will be issued a 1099 form reflecting the value of the prize and are responsible for paying all income taxes on prize. Failure to collect or properly claim any prize in accordance with these Official Rules will result in forfeiture of the prize. If forfeited for any reason, such potential Grand Prize winner will not receive any other prize substitution or compensation and Sponsor will have no further obligation to him/her.
Promotion results will not be changed in light of official adjustments made by the league, though Sponsor reserves the right to make adjustments to Promotion results based on errors or irregularities in their calculation of results or in the transmission of information to Sponsor from third parties. Sponsor, in its sole discretion, also may make adjustments in the event of noncompliance with these Official Rules. Sponsor has no obligation to delay the awarding of any Prize in anticipation of any adjustment, and Sponsor reserves the right to reverse the awarding of any Prize in the event of any adjustment. Entrants agree to be bound by any such adjustments and to cooperate with Sponsor’s reasonable efforts to award Prizes. Decisions of Sponsor are final and binding with respect to all matters related to the Promotion. To the extent that the Website offers or displays scoring, standings, results, statistics, or other information relating to the Promotion, all such information is unofficial and is offered for informational and/or entertainment purposes only.
All potential winners and their predictions are subject to verification by sponsor whose decisions are final and binding on all matters relating to this promotion. An entrant is not a winner of any prize, even if the promotion website or pages should so indicate, unless and until entrant’s eligibility, the answers and full compliance with these official rules have been verified and entrant has been notified that verification is complete. Sponsor will not accept screenshots or other evidence of winning in lieu of its validation process.
NOTIFICATION: The potential Grand prize winner and First prize winners will be notified by Sponsor within three (3) business days following the Promotion or email address provided at the time of entry (the “Prize Notification”). Such method of Prize Notification to be determined by Sponsor in its discretion. Winner must respond within twenty-four (24) hours of the issuance of the text or email address, as determined by Sponsor in its sole and absolute discretion. In the event that the potential winner does not respond to any such Prize Notification within forty-eight (48) hours, or declines the Prize for any reason, the potential winner may be disqualified, and the Prize will be forfeited.

A Prize cannot be transferred by Winner and is valid only for the items detailed above, with no substitution of Prize by Winner. If a Prize is unclaimed within a reasonable time after notification from Sponsor, as determined by Sponsor in its sole discretion, it will be forfeited and Sponsor may, in its sole discretion, select an alternate Winner from the remaining eligible Entries if time permits, or void the Prize. Prior to awarding any Prize, Sponsor may conduct checks for compliance with these Official Rules, eligibility and identity verification, evidence of fraud or other prohibited conduct (as determined by Sponsor in its sole discretion).

Additional Rules & Restrictions: By participating in this promotion, participants agree to abide by and be bound by the Official Rules and the decisions of the judges, which shall be final in all matters relating to this promotion. If winner is found in violation of these Official Rules, he/she may be required to forfeit his/her prize. Acceptance of the prize constitutes permission for the Sponsor and its agencies to use winner’s name, address (city and state), image, voice, photograph, biographical information, prize information and/or likeness for purposes of advertising and trade worldwide in any and all media, now known or hereafter devised, without territorial or time limitation or further compensation, notification or permission, unless prohibited by law. By participating, participants agree to hold Sponsor, Grand Prize Promotions, and their respective parents, affiliated companies, subsidiaries, advertising and promotion agencies, and all other companies associated with this promotion and each of their respective directors, officers, employees and assigns (collectively, the “Released Parties”) harmless from and against any and all claims, damages and liability of any kind arising from or in connection with the acceptance, possession or use/misuse of any prize, or participation in the promotion, and assume all liability therefor.

CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE, HACK, ALTER, RE-ROUTE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Released Parties are not responsible for: (i) electronic transmissions or registrations and/or game plays that are lost, late, stolen, incomplete, inaccurate, damaged, garbled, destroyed, misdirected, undelivered, delayed or not received by the Released Parties or their respective agents for any reason and all such registrations and/or game plays will be void, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of registrations or game plays, or for destruction of or unauthorized access to, or alteration of, registrations or game plays, (iii) failed or unavailable hardware, network, software, cable, satellite, Internet Service Provider (ISP), or telephone transmissions, damage to participants’ or any person’s computer and/or its contents, or causes that jeopardize the administration, security, fairness, integrity or proper conduct of this promotion, (iv) any other mechanical, technical, printing, typographical, human, electronic, computer, technical or other errors or malfunctions relating to or in connection with the promotion, including, without limitation, errors or malfunctions which may occur in connection with the administration of the promotion, the processing of registrations and/or game plays, the announcement of the prize, or in any promotion-related materials, or (v) any registrations and/or game plays submitted in a manner that is not expressly allowed under these Official Rules and all such registrations and/or game plays will be void. Sponsor reserves the right to terminate the promotion for any reason, including if fraud, misconduct, technical failures or other causes destroy or threaten the integrity of the promotion, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the promotion as determined by Sponsor/Administrator, in their sole discretion. In the event the promotion is terminated, Sponsor reserves the right to award the Grand Prize only for a valid and eligible prize claim submitted up to such termination. If due to a computer programming, network or other error, more Grand Prizes are claimed than intended to be awarded according to these Official Rules, the Grand Prize may be awarded in a random drawing from among all valid and non-suspect eligible prize claims received, at Sponsor’s sole discretion. In no event will the Released Parties be liable for more than the stated number of prizes in these Official Rules. In the event a dispute as to a registration or game play submitted by multiple users having the same e-mail account, the registration and/or game play will be deemed made by the authorized account holder of the e-mail address submitted at the time of registration, and such person will be required to meet the eligibility requirements of these Official Rules. “Authorized account holder” means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be requested to provide proof (to the Released Parties’ satisfaction) that they are the authorized account holder. Any damage made to the website will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of registration. Proof of submitting a game play will not be deemed to be proof of receipt by Sponsor.

In Case of Disputes: Each participant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or the prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of GA; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this promotion, and in no event will any participant be entitled to receive attorneys’ fees or any other legal costs; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with, the laws of the State of GA , without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of GA or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of GA.
